I have not seen an answer to this question anywhere. However, I have a few opinions on this subject that I'd like to offer:
1. One of the reasons could be that Baha'u'llah revealed the law of burial in Akka many years after the martyrdom of The Báb. And since this law was not retroactive it did not apply to the remains of the Báb.
2. Another reason could be that there was divine wisdom in having the remains of the Báb be buried on God's Holy Mountain (e.g. the enemies of the Faith wanted no trace of the Báb be left on earth, and through God's will ("He doeth whatsoever He willeth") those enemies did not succeed).
3. As you know, His Holiness Bahá'u'lláh, The Most Great Infallibility, and 'Abdu'l- Bahá, having been conferred infallibility by Bahá'u'lláh and the authorized Interpreter of His words, did not object to the moving of the holy remains of the Báb to the Holy Land for proper burial on God's Holy Mountain. Therefore, it qould stand to reason that the law of burial was not violated but, rather, OUR understanding of this particular law is presently limited which could require further elucidation by the Universal House of Justice, also infallible.
And you are quite right about the threat of desecration since the Báb's house in Shiraz was demolished and, in effect, desecrated.
